Terms of Service

Terms for using W2A GLOBAL TECH technology consulting and W2A Tech software services.

Effective date:

1. Our services and these terms

W2A GLOBAL TECH ("W2A", "we", "us") provides technology consulting and W2A Tech software for business communications, customer support, customer relationship management and authorized automation. These terms apply to use of those services. A separate written agreement may set additional service-specific terms; where it expressly addresses the same issue, that agreement governs to the extent permitted by law.

Features available to an organization depend on its configuration and service arrangement. Pilot or limited-release features may not be available generally. A roadmap or a Coming Soon notice is not a commitment to deliver a feature or a launch date.

2. Eligibility and authorized access

You must have legal capacity to enter the applicable agreement. If acting for an organization, you must have authority to do so. Use only accounts and workspaces you are authorized to access, provide accurate account information, protect sign-in credentials and notify us of suspected unauthorized use at info@w2aglobal.com.

Organizations are responsible for managing their users, permissions, connected accounts and the information they choose to process. Do not access another organization's information, share access improperly or try to bypass technical or approval controls.

3. Customer responsibilities

You are responsible for the lawfulness, accuracy and permitted use of the data, instructions and content you provide. Give required privacy notices and obtain any permissions or consent required for processing, contacting recipients and using connected providers. Maintain records of consent and honor opt-outs and other applicable rights.

Review consequential business decisions and content before relying on them. You remain responsible for your customer relationships, offers, sales records, financial entries and professional obligations. The platform does not replace legal, accounting, financial or other professional advice.

4. Messaging and acceptable use

Do not use the services for unlawful activity, fraud, impersonation, harassment, spam, malware or infringement of another person's rights. Do not send unsolicited messages or contact people in violation of applicable law, consent requirements or the rules of the connected messaging platform.

Respect platform limits, human handoff controls and approval requirements. Campaigns require the designated organization Owner's approval; neither an AI response nor the existence of a sending tool authorizes bypassing that approval or recipient consent. Do not probe or disrupt the service, extract credentials or defeat tenant isolation or security controls.

5. AI and automation limitations

AI-generated replies, summaries, classifications and suggestions may be inaccurate, incomplete or inappropriate. Similar inputs can produce different outputs. Review outputs in context and use appropriate human oversight. Automated tools may only act within their configured permissions and safeguards; they are not an independent source of authority.

We do not guarantee the accuracy of AI output or a particular business outcome. Do not rely on the service as an emergency service or as the sole basis for decisions requiring qualified professional judgment.

6. Content and intellectual property

You retain the rights you hold in the content and data you provide. You authorize the processing, hosting, transmission and display needed to provide the services under the applicable agreement and your authorized instructions, including processing by relevant service providers.

W2A and its licensors retain their rights in the software, service design and materials they provide. Your permission to use the service does not transfer those rights. Rights in separately commissioned consulting deliverables are determined by the applicable written agreement. AI output may not be unique, and you are responsible for reviewing third-party rights before using it.

7. Third-party services and availability

The service depends on hosting, communications, email and AI providers. Their own terms and policies may apply, including Meta's and WhatsApp's requirements for connected messaging. Their outages, restrictions, changes or account decisions may affect availability and delivery.

Maintenance, failures and security measures can interrupt access. Unless expressly agreed in writing, we do not promise uninterrupted availability, a particular service level, successful message delivery or compatibility with every third-party service.

8. Fees and service arrangements

Any fees, payment terms, service period and cancellation arrangements must be set out in the proposal, order or other agreement you accept. These public terms do not establish a price, an automatic renewal or a self-service subscription. Third-party charges may be governed by your arrangements with those providers.

9. Suspension and termination

Access may be restricted or suspended where reasonably necessary to address security risks, unauthorized use, legal requirements or a material breach of the applicable agreement. Termination and any notice or payment obligations are subject to that agreement and applicable law.

You may contact info@w2aglobal.com about ending service or requesting your information. Ending access is separate from permanent data deletion. Retention and deletion are addressed in the Privacy Policy and Data Deletion Instructions.

10. Disclaimers and liability

To the extent permitted by applicable law and except for express commitments in a separate written agreement, the services are provided on an "as is" and "as available" basis. We do not give implied warranties of merchantability, fitness for a particular purpose or non-infringement where those warranties may lawfully be excluded.

To the extent permitted by applicable law, neither party is liable to the other under these terms for indirect or consequential losses resulting from use of the service. Nothing in these terms excludes or limits liability, remedies or consumer rights that cannot lawfully be excluded or limited. Any further allocation or cap on liability must be addressed in an applicable written agreement.

11. Applicable law and disputes

Contact info@w2aglobal.com first so that we can try to resolve a service concern. These public terms do not designate a particular state's law, exclusive court or mandatory arbitration procedure. Any agreed governing law and dispute procedure must be set out in the applicable written agreement; otherwise the law and courts with jurisdiction apply. Mandatory statutory protections remain available.

12. Updates and contact

We may update these terms as services or requirements change, subject to any notice or agreement required by applicable law. The published version identifies its effective date. Contact W2A GLOBAL TECH at info@w2aglobal.com for questions about the service or these terms.
